REAL ESTATE AUCTIONTERMS & CONDITIONS
By registering and bidding, each bidder acknowledges that he or she has read, understands, and agrees to the following Terms and Conditions:
This property will be offered at auction with reserve. The Seller reserves the right to accept or reject the final high bid. The property is subject to sale prior to auction unless otherwise announced.
All bidders must complete registration form prior to bidding and show valid drivers license or government issued ID card. Each bidder must present $10,000 in certified funds at registration. Acceptable certified funds include a cashier’s check or certified bank check payable to “Fairhope Title Services” or as announced by the Auctioneer at registration.
The successful high bidder’s $10,000 certified funds shall be retained as the earnest money deposit and applied toward the purchase price at closing. All unsuccessful bidders will have their certified funds returned immediately following the auction.
A 10% Buyer’s Premium will be added to the final high bid to determine the total contract purchase price.
Example: A high bid of $500,000 plus a 10% Buyer’s Premium equals a contract purchase price of $550,000.
Immediately upon acceptance of the final bid by the Seller, the successful bidder shall execute a Real Estate Purchase Agreement and all related documents required by the Auctioneer and/or Seller.
The property is being sold in its present “AS IS, WHERE IS” condition, with all faults, if any, and without representations or warranties of any kind, expressed or implied, except as may be specifically stated in the purchase agreement. Bidders are encouraged to inspect the property and conduct all desired due diligence prior to bidding.
The sale is not contingent upon financing. Each bidder is solely responsible for obtaining any financing prior to the auction. The successful bidder’s failure to secure financing shall not relieve the bidder of the obligation to close.
Closing shall occur on or before 30 days from the auction date, unless otherwise stated in the purchase agreement. Time is of the essence.
Seller shall convey good and marketable title by deed consistent with the purchase agreement, subject to easements, restrictions, covenants, and matters of record. Closing costs, title insurance premiums, recording fees, prorations, and other customary costs shall be allocated as set forth in the purchase agreement.
Possession shall be delivered to Buyer at closing, unless otherwise provided in the purchase agreement.
Any announcements made by the Auctioneer on auction day shall take precedence over all prior advertising, brochures, or printed material. The Auctioneer reserves the right to control the bidding, settle bid disputes, reject irregular bids, and make all decisions regarding the conduct of the auction.
If the successful bidder fails to sign the purchase agreement or fails to close in accordance with the contract terms, the earnest money deposit may be forfeited, and Seller may pursue any additional remedies available under the purchase agreement and Alabama law.
The Auctioneer and any cooperating real estate licensees represent the Seller unless otherwise disclosed in writing.
